The Main Conditions for Getting Compensation for delayed or Cancelled Flights

 

To be eligible for compensation for flight delay or cancellation, you must submit an online application to the airline through the site Passenger.am. For this you are kindly invited to fill in an online application form, sign the appropriate power of attorney (authorization) form and attach the electronic version of at least the following documents and information:

 

  1. the ticket reservation, where the booking and travel information is indicated
  2. a copy of a valid passport – the copy of 2-5 pages in PDF format
  3. the boarding passes, if available
  4. Sign to attest formally that all the provided information is true and to best of your knowledge and that the Passenger is aware of the responsibilities defined by laws for providing false or obviously false information.

 

Passenger.am LLC as a legal team specialized as a mediator, operates and intervenes to protect and restore the rights and lawful interests of the Passenger, it serves as a mediator between the Passenger and the allegedly violating airline.

 

What factors do affect the size of the compensation payment?

 

The size of the compensation depends on the contract defined for that flight and applied international and national legal norms. The passenger is entitled to compensation for at least 3 hour delay.

 

The compensation size depends on the following factors.

 

  • Flight delay notification and its dates and causes (emergency landing, accident, etc.).
  • Offering an alternative transportation on a timely manner.
  • Flight distance.

 

In case of delays up to 2 hours, the airline does not carry any responsibility. However, under its internal rules, it can provide additional services, which is very rare.

 

In case the flights are delayed for more than 2 hours, the airline is obliged to provide the passengers with the opportunity of making free of charge two telephone calls, telex or fax messages, or e-mails. provide with meals and refreshments.

In case the flights are delayed for more than 3 hours, the airline is obliged to provide the passengers with compensation if the delay is the fault and /or responsibility of the airline.

In case the flights are delayed for more than 6 hours, the airline is obliged to provide the passengers with a free stay at a hotel and to organize their transportation.

 

How to obtain compensation for flight delay?

 

Here is the list of the necessary steps to be taken with Passenger.am to claim for compensation:

 

  1. The passenger personally and directly should fill in and sign the online form indicating the circumstances created (flight delay).
  2. The copy of 2-5 pages of a valid passport in PDF format.
  3. The confirmed e-mail of the booked flight (e-mail, airline company booking, etc.)
  4. Presentation of all the available receipts.
  5. Ticket and boarding information.
  6. The amount of the (compensation) available, which is calculated by our team according to the flight distance (250-600 euro).
  7. In case of a minor Passenger, as well as in case of a Passenger with restricted capacities, the online claim is filled in with the information of the minor Passenger or the Passenger with restricted capacities but signs one of the parents, or the legally authorized representative, also indicating his/her passport information.
  8. Sign to attest formally that all the provided information is true and to the best of your knowledge and that the Passenger is aware of the responsibilities defined by laws for providing false or obviously false information.

 

What to do if the flight has been cancelled?

If the air carrier is responsible for the flight delay, then according to the EU 261/2004 Regulation, international treaties and the legislation of the Republic of Armenia, the latter is obliged to properly take care of the Passengers starting from the cases of 2 hours delay, compensate them depending on the delay period.

If you are going to claim compensation from the airline, you need facts on the flight delay. For this you need to

  • Save all the necessary documents on the flight, the boarding pass and other documents where indicated your reservation confirmation number. These documents can have probative force.
  • Comments and photos: Your complaint must include comments such as the real arrival time of the airplane, also photos that will show  the screens of the airport where the delay will be fixed.
  • Refuse to sign or accept any offer that will reduce your rights.  It may be a “trap” from the side of the air carrier to deny compensation in the future.

How to obtain compensation for flight delay?

The Passenger should  submit to the airline an online claim through the Passenger.am website with the following documents and  information;

  1. The copy of the ticket  with boarding information
  2. The copy of  2-5 pages of a valid passport in PDF format
  3. The boarding passes and other receipts
  4. Sign to attest formally that all the provided information is  true and to the best of your knowledge and that the Passenger is aware of the responsibilities defined by laws for providing false or obviously false information.

How much compensation is possible to get for 2 hour flight delay?

In case of delays up to 2 hours, the airline does not carry any responsibility. However, it is responsible to take care of the passengers, provide with free of charge two telephone calls, telex or fax messages, or e-mails.

If necessary, some airlines may provide luggage maintenance free of charge.

Which are the cases when no compensation is provided for delayed flights?

According to the EU 261/2004 Regulation, international treaties and the legislation of the Republic of Armenia,  no compensation is provided for the delayed flight if

  • The flight was carried by a non-EU air carrier
  • The flight started from a non-EU airport by a non-EU registered airplane, for instance  from Yerevan to Dubai
  • If the flight delay was caused by “extraordinary circumstances”
  • If the passenger is informed about the flight delay 14 days beforehand and if  an alternative flight is suggested. However, if an EU registered airline departs from a non EU airport, the regulations are still applicable for the airline  registered in EU, for instance in case of a flight from Yerevan to Bucharest.
